Welcome to Pickleball Circuit! These Terms and Conditions ("Terms") govern your access to and use of the Pickleball Circuit website, including any content, functionality, and services offered on or through www.pickleballcircuit.co.uk (the "Site"), whether as a guest or a registered user.

Please read these Terms carefully before you start to use the Site. By using the Site, or by clicking to accept or agree to the Terms when this option is made available to you, you accept and agree to be bound and abide by these Terms and our Privacy Policy, found at Privacy Policy, incorporated herein by reference. If you do not want to agree to these Terms or the Privacy Policy, you must not access or use the Site.

This Site is offered and available to users who are 13 years of age or older. If you are under 18, you may only use the Site with the consent of a parent or legal guardian. By using this Site, you represent and warrant that you meet all of the foregoing eligibility requirements.

1. Definitions

• "Site" refers to the Pickleball Circuit website located at www.pickleballcircuit.co.uk and all associated services.
• "we," "us," "our" refers to PickleballCircuit, the operator of Pickleball Circuit.
• "User," "You," "Your" refers to any individual accessing or using the Site, including players, guests, and administrators.
• "Event" refers to any tournament, league, clinic, or other pickleball-related activity organized and listed on the Site.
• "Content" means all information, data, text, software, music, sound, photographs, graphics, video, messages, or other material.

2. Changes to the Terms

We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them and apply to all access to and use of the Site thereafter. Your continued use of the Site following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page frequently so you are aware of any changes, as they are binding on you.

3. Accessing the Site and Account Security

• We reserve the right to withdraw or amend this Site, and any service or material we provide on the Site, in our sole discretion without notice. We will not be liable if for any reason all or any part of the Site is unavailable at any time or for any period.
• To access certain features of the Site, you may be asked to provide certain registration details or other information. It is a condition of your use of the Site that all the information you provide on the Site is correct, current, and complete.
• If you choose, or are provided with, a username, password, or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any other person or entity. You are responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized access to or use of your username or password or any other breach of security.
• We have the right to disable any user account, at any time in our sole discretion for any or no reason, including if, in our opinion, you have violated any provision of these Terms.

4. Event Registration and Participation

• Eligibility:
  • To register for an Event, you must meet any eligibility criteria specified for that Event, including but not limited to age, skill level, and gender (for gender-specific categories).
  • You are responsible for the accuracy of all information you provide during registration and in your user profile, including any self-declared skill ratings (e.g., DUPR). Providing false or misleading information, including an inaccurate skill rating to enter an inappropriate category, may result in disqualification from Events, suspension of your account, and forfeiture of any fees paid, at our sole discretion.
• Fees and Payments:
  • All Event fees and category fees must be paid in full by the specified deadlines through our designated payment processor (Stripe) or any alternative payment methods specified for a particular Event.
  • Fees are typically non-refundable except as explicitly stated in an Event's specific cancellation policy, as determined by us for Events we directly organize, or as required by applicable law. For Events organized by Third-Party Organizers (see Section 8 - Third-Party Events), their specific refund policies will apply.
  • We reserve the right to change fees for Events we directly organize at any time. For Third-Party Events, fee changes are at the discretion of the Third-Party Organizer.
• Partners: For doubles events, you may be required to register with a partner. If you register as "seeking a partner" or use our "Find Partner" features, we make no guarantee that a suitable partner will be found. You are responsible for communicating with and confirming your partner.
• Conduct: All participants are expected to adhere to the rules of pickleball, display good sportsmanship, and comply with any specific rules or codes of conduct set forth by the Event organisers (whether Pickleball Circuit or a Third-Party Organizer) or venue. We, or the relevant Third-Party Organizer, reserve the right to remove any participant from an Event for unsportsmanlike conduct, violation of rules, or any behavior deemed detrimental to the Event, without refund.
• Waiver and Release of Liability:
  • Participation in pickleball events involves inherent risks of injury. By registering for and participating in an Event listed on the Site, you acknowledge these risks.
  • You agree to waive, release, and discharge Pickleball Circuit (for its role as the platform provider and for any Events it directly organizes), its officers, employees, and agents from any and all liability for any injury, loss, or damage sustained by you in connection with your use of the Site and participation in Events, except where caused by our gross negligence or willful misconduct.
  • For Events organized by Third-Party Organizers, you acknowledge that Pickleball Circuit is solely a platform provider, and any waiver, release, or assumption of risk specific to that Event is primarily between you and the Third-Party Organizer, as may be detailed in their specific event terms.
• Image Release: By participating in Events listed on the Site, you consent to the potential use of your likeness in photographs, video recordings, or other media taken during the Event for promotional, marketing, or other legitimate purposes of Pickleball Circuit and/or the specific Event Organizer, without compensation, unless you expressly notify the photographer or organizer at the Event of your objection.
• Event Cancellation/Changes:
  • For Events directly organized by Pickleball Circuit, we reserve the right to cancel, postpone, or modify such Events due to unforeseen circumstances. In such cases, we will endeavor to notify registered participants, and any refund or credit policy will be determined at our discretion.
  • For Events organized by Third-Party Organizers, the Third-Party Organizer is responsible for their event's cancellation, postponement, or modification policies, and any related communications and refunds. Pickleball Circuit is not responsible for refunds for Third-Party Events unless explicitly stated.

5. Intellectual Property Rights

• The Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by us, our licensors, or other providers of such material and are protected by United Kingdom and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
• These Terms permit you to use the Site for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site, except as incidentally necessary to use the Site.

6. User Contributions

The Site may allow you to create or complete a user profile, post messages or content in forums or other interactive areas, submit feedback, or otherwise transmit or make available information or material ("User Contributions").

• You are solely responsible for your User Contributions and the consequences of posting or publishing them. By providing any User Contribution on the Site, you grant us and our affiliates and service providers, and each of their and our respective licensees, successors, and assigns a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Contributions in connection with the Site and our (and our successors' and affiliates') business, including without limitation for promoting and redistributing part or all of the Site (and derivative works thereof) in any media formats and through any media channels.
• You represent and warrant that: (i) you own or control all rights in and to the User Contributions and have the right to grant the license granted above to us and our affiliates and service providers, and each of their and our respective licensees, successors, and assigns; (ii) all of your User Contributions do and will comply with these Terms; and (iii) your User Contributions will not infringe any patent, trademark, trade secret, copyright, or other intellectual or proprietary right of any other person, or violate the legal rights (including the rights of publicity and privacy) of others or contain any material that could give rise to any civil or criminal liability under applicable laws or regulations or that otherwise may be in conflict with these Terms and our Privacy Policy.
• You understand and acknowledge that you are responsible for any User Contributions you submit or contribute, and you, not Pickleball Circuit, have full responsibility for such content, including its legality, reliability, accuracy, and appropriateness.
• We are not responsible or liable to any third party for the content or accuracy of any User Contributions posted by you or any other user of the Site. We have the right (but not the obligation) to:
  • Remove or refuse to post any User Contributions for any or no reason in our sole discretion.
  • Take any action with respect to any User Contribution that we deem necessary or appropriate in our sole discretion, including if we believe that such User Contribution violates the Terms, infringes any intellectual property right or other right of any person or entity, threatens the personal safety of users of the Site or the public, or could create liability for Pickleball Circuit.
  • Disclose your identity or other information about you to any third party who claims that material posted by you violates their rights, including their intellectual property rights or their right to privacy.
  • Take appropriate legal action, including without limitation, referral to law enforcement, for any illegal or unauthorized use of the Site.

7. Prohibited Uses

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to use the Site:

• In any way that violates any applicable national or international law or regulation.
• To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation.
• To impersonate or attempt to impersonate Pickleball Circuit, a Pickleball Circuit employee, another user, or any other person or entity.
• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Site, or which, as determined by us, may harm Pickleball Circuit or users of the Site, or expose them to liability.

8. Third-Party Event Organizers

The Site may feature Events that are organized and managed by independent third-party individuals or entities ("Third-Party Organizers"). For such Events:

• Pickleball Circuit acts solely as a platform provider to facilitate discovery, registration, and payment (where applicable and where Pickleball Circuit's payment system is used by the Third-Party Organizer).
• The Third-Party Organizer is solely responsible for all aspects of their Event, including but not limited to: event details, accuracy of information, venue, scheduling, rules, safety, on-site management, participant conduct, prize distribution, and any specific Event terms, conditions, or waivers.
• Any specific terms, conditions, cancellation policies, or refund policies set by a Third-Party Organizer for their Event will be displayed on the Event's detail page where provided by the Third-Party Organizer and will take precedence over any general policies of Pickleball Circuit for that specific Event, particularly concerning refunds or event modifications.
• You acknowledge that your participation in a Third-Party Event is an agreement primarily between you and the Third-Party Organizer. Pickleball Circuit makes no warranties or representations regarding Events run by Third-Party Organizers.
• Any disputes or claims arising from a Third-Party Event should be directed primarily to the Third-Party Organizer. Pickleball Circuit may, at its discretion, offer assistance in facilitating communication but is not responsible for resolving such disputes.
• Payment processing for Third-Party Events may be handled directly by the Third-Party Organizer using their own Stripe account or other payment methods, or through Pickleball Circuit's Stripe account as an intermediary. The payment terms will be specified for each Event.

9. Disclaimers

• YOUR USE OF THE SITE, ITS CONTENT, AND ANY SERVICES OR ITEMS OBTAINED THROUGH THE SITE IS AT YOUR OWN RISK. THE SITE, ITS CONTENT, AND ANY SERVICES OR ITEMS OBTAINED THROUGH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
• NEITHER WE NOR ANY PERSON ASSOCIATED WITH US MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SITE, **INCLUDING ANY INFORMATION PROVIDED BY THIRD-PARTY ORGANIZERS FOR THEIR EVENTS.**
• WE DO NOT WARRANT THAT THE SITE, ITS CONTENT, OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE SITE WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT OUR SITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Limitation on Liability

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL PICKLEBALL CIRCUIT, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SITE, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE SITE OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

THE FOREGOING DOES NOT AFFECT ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

11. Indemnification

You agree to defend, indemnify, and hold harmless Pickleball Circuit, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Site, including, but not limited to, any use of the Site's content, services, and products other than as expressly authorized in these Terms or your use of any information obtained from the Site.

12. Governing Law and Jurisdiction

All matters relating to the Site and these Terms, and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of England and Wales without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Site shall be instituted exclusively in the courts of England and Wales. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

13. Termination

We may terminate or suspend your access to all or part of the Site immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Site will immediately cease.

14. Entire Agreement

The Terms and our Privacy Policy constitute the sole and entire agreement between you and Pickleball Circuit regarding the Site and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Site.
